When I looked at your link, and saw that it was from Chickashaw, OK, I new that this had to be him.  He bought a heifer out of our fall sale 5 years ago for $2750. I got the check, and sent her to OK from IN. No problem.  Then, he bought a Heatwave heifer off of us private treaty in late November of that same year for $4250.  He sent a check, so I put her on a trailer headed for the Exposure sale.  For the first couple months, he would answer our phone calls and promised to send a new check. It never happened. Finally after 1 1/2 years of screwing around with this guy, we got an attorny, we sent a certified letter to him stating that he had 10 days to respond or we were filing a lawsuit. We never heard anything, so we proceeded with filing the lawsuit.  We decided to file here in Indiana since we could file for 3 times what the check was written for.  Our attorney named him and his wife in the lawsuit and it was delivered to their house by the sheriff dept. Within 48 hours of receiving the lawsuit, Mr. Henderson's in-laws wired us the money plus attorney fees.  Hopefully this time, he ends up in jaile for awhile.

Either you folks have a lot more cash in your pockets or a hell of a lot more kindness in your hearts - because anyone steals 4grand for me - jail would be the safest place for them.  Im not trying to be billy bad ass but- damn 4 grand! come on. I'd be banging on his door the next day collecting my cash... or his guns... or his grandmas china.. ya know whatever I felt like taking to rectify the situation.

a lawsuit- a lean??? There's no debtor's prison- he's obviously a low-life if the checks are bouncing- what do you expect to gain?

Actually its funny you mention debtor's prison. There has been a recent surge of people being placed in jail over debt.

Where I work we receive checks for payment daily, and some can be for some serious cash. I have had to send several NSF checks to the DA. One thing that you can do to protect yourself is very simple. Always, ALWAYS get their drivers license and write the license number on the check and put your initials next to it. When someone gives you a hot check, the only way they can get out of it in a court of law is by saying they weren't the ones writing the check. There are ways to get around that, but if you have their drivers license number on the check they just wrote (be sure everything adds up as far as name, address, etc) its air tight. You have just proven that they were the ones writing the check to you. There is nothing worse than a thief.

I have heard of several people who have had issues similar with him.  I know around here he "buys" several calves on private treaty sales, and then he decides which one he feels is the best deal and that is the one he takes.  Fortunately for us the prior 2 years ours were evidently "the best deal". In our situation it qualified as a felony. Therefore he had no choice but to pay, or he would have received jail time..... and still have had to pay.

I guess in our situation we were more upset about the principal rather than the money.  I find it interesting hearing people complain about things with breeders/jocks.  I think if they knew the stuff that we deal with they would have a completely different opinion/understanding of it.  I guess I'm dumbfounded by the idea that people buy things that they never have any intention of paying for/have the money to pay for.  I realize that people can have hardships... I get that, but intentionally doing it is an entirely different thing.  I can guarantee you if I write someone a check.... it will go through.

Even cash isn't king all the time, I took a fake $100 bill a couple weeks ago out of a $1200 payment.

It was actually a $5 dollar bill with a $100 print image on it.  So it would have passed marker test, but when I went to deposit it, the sorting machine caught it.  The little strip inside it still read $5.  The bank confiscates it right there and hands it over to police.
