How long to wait on check?

Just my two cents, but if they are big time players in this game we play with show cattle put their name out as none paying customers. It will do one of two things get your check or warn everbody else to be leary of deals with this pe
rson.

The legal system is different in each state, etc..  So you should always check with your local civil laws.

My view regarding promissory notes:  it sounds great, but in one word they are "useless".    Any time you allow someone to pay you later (as was previously noted on this thread) you are entering into what is for all purposes a personal loan.  Whether it is by word, written, or blood.  If they do not pay, it is your problem.  Congratulations, you are the bank with a defaulted loan.  It will cost money and time to attempt to retrieve what was yours in the first place.  And if it looses value, too bad for you.  And often times you may be in the right, but never get any type of satisfaction, or only partial satisfaction.   

I deal with people and financial issues on a daily basis.  I have learned many things. 

A.  Bad apples do exist. 
B.  Bad apples need trusting people to work their magic. 
C.  If someone doesn't have the $$ today, what is really going to change tomorrow?  Nothing.  "Pay check Friday" they are waiting on will vanish from the calendar to never be seen again the instant you sign a promissory note.   
D.  Being someone's bank NEVER pays.  If a bank or lending institution will not trust them enough to lend money, WHY should YOU?
E.  Honest people are never upset by asking for payment upon delivery of a product.   
F.  To some people, you are the "world".  These people think the "world" owes them. 

Phrases that should make you run...   

"I don't care how much it costs."  Translation: I don't care how much.....I don't plan on paying anyway, or  I don't have any money anyway.   

"I get paid next week."  Translation:  I get paid next week and I'm glad I got this on credit cause now I got beer money, or I get paid next week, not sure when you're getting paid.   

"Can you hold a check?"  Trans:  I have a checking account, and I don't mind writing a check I can't afford cause there is no money there anyway.

"Can I write a post dated check?"    Trans:  Ha! This has no legal grounds, Sucker! 

"I got the money, but I can't get to it for a couple of days."  Trans:  I'm hoping to have a couple day head start before you realize I ain't paying.

A lot of traders will not pay for cattle 'til after they sell them - I'm not saying it's right, but it's how it is and if you're going to sell cattle to these guys, you're just going to have to learn to live with it.  If you want to get paid when the cattle are picked up, you need to make that clear when you price them.  Some of 'em will come through with it, but realize that some of 'em won't buy from you because of it. We've never not been paid, but often it takes long enough to be a little spooky.  In the long run, I think it makes money, just have to be willing to take the chance.

Cattle dont leave my place without a check, and I buy and sell cattle for people, I never pick a calf up without having payment for it, UNLESS someone ask me to take a calf and try to sell it for them. But even then they know I have the calf because in that situation I charge them for feed etc.  I will tell you this way a GOOD trader will pay you up front, because a GOOD trader has done good business and has the money to back his mouth up, or they will bring any potential customers to your place to look at cattle. This day in age its hard to trust anybody, and if you notice lately there are a ton of post on here about fraudulent bidders in sales, people taking cattle and not paying for them, etc. Cant be to careful. 

P.S. I kinda have a feeling a lot of these people are refering to the same person that isnt paying...but no proof...regardless I think we should start a "Did Not Pay" list or Black List on here as a warning to people so that others no to be warry of certain individuals.

You can go to small claims court and file a claim.  Don't know if they live in the same state much less the same county, but its an option.

I wouldn't wait very long before I told the world this dude's name . You might not get paid either way, but putting his name on this " bully pulpit" might save someone else some grief.

TwistedH is a wonderful trader. Straight up and very very helpful. Doing business with somebody like him who you can trust makes you feel a lot safer.

I have had calves go to a trader knowing I was not going to get paid till after the sale.  We worked out an agreement and we both trusted each other.  I would not do this with someone that I did not have a long time relationship with, but I have done it several times and have always been pleased.  Once they took a couple calves and did not get one sold.  They kept her a couple months then called me and I went and picked her up and got paid for the other one.  The next time only took one and they sold her and I had my money within a month.  I have had this trader send people to my house and I have sold calves.  I always just send them a little money for the referral.
